The lawsuit alleges Ferrara failed to ensure the product was safe and failed to disclose the presence of arsenic.

The FDOH found that more than 96 pieces of Nerds candy exceed the amount of arsenic a child can safely consume in a year.

Ferrara Candy Co. is accused of failing to alert consumers regarding the presence of arsenic in its popular candy brands like Trolli gummies, Nerds, Sweet Tarts, Laffy Taffy and more, according to a proposed class action filed Wednesday in Illinois federal court.
